3. Scope of Services
All services are delivered based on agreed-upon proposals, statements of work, or service agreements. Results in digital marketing are not guaranteed. We do not promise specific rankings, revenue outcomes, traffic volumes, or lead counts unless explicitly stated in a signed agreement.
Marketing is a performance game, not magic.
4. Client Responsibilities
To achieve optimal results, clients agree to:

Provide accurate, complete, and timely information

Grant necessary access to websites, analytics, ad accounts, and platforms

Respond to requests and approvals in a reasonable timeframe

Comply with all applicable laws and platform policies
Delays or failures caused by incomplete cooperation are not our responsibility.
5. Payments & Fees

All fees are due as outlined in your proposal or agreement

Late payments may result in paused services

Fees are non-refundable unless explicitly stated otherwise in writing

We reserve the right to adjust pricing with prior notice for ongoing services
No pay, no play.
6. Intellectual Property
Unless otherwise agreed in writing:

We retain ownership of proprietary frameworks, strategies, processes, and methodologies

Clients own their final paid-for deliverables (e.g., websites, ad creative)

We reserve the right to showcase work in our portfolio and marketing materials
Unauthorized reuse or redistribution of our materials is prohibited.
7. Confidentiality
Both parties agree to maintain the confidentiality of sensitive, proprietary, or non-public information exchanged during the course of the engagement. This obligation survives termination of services.
8. Third-Party Platforms & Tools
We may use third-party tools (Google, Meta, CRM platforms, hosting providers, etc.). We are not responsible for outages, policy changes, account suspensions, or algorithm updates controlled by third parties.
We play the game. We don’t own the field.
9. Disclaimers
All services are provided “as is” and “as available.” We make no warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or uninterrupted service.
Marketing involves risk. You acknowledge that.
10. Limitation of Liability
To the maximum extent permitted by law, Perfection Marketing shall not be liable for any indirect, incidental, consequential, or special damages, including lost profits or data, arising from your use of our services or website.
Our total liability shall not exceed the amount paid to us in the six (6) months preceding any claim.
11. Indemnification
You agree to indemnify and hold harmless Perfection Marketing, its team, and affiliates from any claims, damages, losses, or expenses arising from your business, content, products, services, or violation of these Terms.
12. Termination
Either party may terminate services in accordance with the terms outlined in the applicable agreement. Outstanding balances remain due upon termination.
13. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.
14. Changes to These Terms
We may update these Terms at any time. Continued use of our website or services constitutes acceptance of the revised Terms.
